Terms of Service
These Terms govern your use of Waypoint (“Waypoint”, “we”, “us”), a personal photo-mapping service operated by an individual. By creating an account or using the service, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use Waypoint.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use Waypoint. By using it, you confirm you meet that requirement.
2. What Waypoint does
Waypoint lets you upload photos, automatically maps them using the location and date stored in each photo, and lets you view your trips and share them with people you choose. Features may change over time.
3. Your content
You own your photos. You keep all rights to the content you upload. To run the service, you grant us a limited license to store, process, resize, and display your content solely to provide Waypoint to you and to the people you share a trip with — nothing more. We don’t use your photos to advertise, and we don’t claim ownership of them.
You are responsible for the content you upload. You confirm you have the right to upload it and that it does not infringe anyone else’s rights or violate the law.
4. Acceptable use
You agree not to upload or share content that is illegal, infringing, or that you don’t have the right to use. In particular, you must not use Waypoint to store or share child sexual abuse material or any other unlawful content, to harass others, or to attempt to break, overload, or gain unauthorized access to the service. We may remove content and suspend or terminate accounts that violate these Terms, and we may report unlawful content to the authorities as required by law.
5. Your account
Keep your password secure and don’t share your account. You’re responsible for activity under your account. Tell us promptly if you believe your account has been compromised.
6. Availability, backups, and “as is”
Waypoint is provided “as is” and “as available,” without warranties of any kind. We work hard to keep the service running and to protect your data, but we can’t guarantee it will always be available, error-free, or that data will never be lost. Please keep your own copies of important photos — Waypoint is not a substitute for your own backups.
7. Limitation of liability
To the fullest extent permitted by law, Waypoint and its operator will not be liable for any indirect, incidental, or consequential damages, or for any loss of data, arising from your use of (or inability to use) the service. Because Waypoint is a small, low-cost/free personal service, our total liability to you is limited to the amount you paid us, if any, in the 12 months before the claim.
8. Termination
You can stop using Waypoint and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the service. On termination, your trips and photos are deleted as described in the Privacy Policy.
9. Changes to these Terms
We may update these Terms from time to time. When we make material changes we’ll update the version date above and, where appropriate, ask you to review and accept the updated Terms.
10. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. If you use Waypoint from outside the United States, you are responsible for complying with your own local laws.
